Memery Crystal advised Kensington Creperie in a case against Allianz Insurance plc for denied coverage for COVID-19 related business interruption losses.

 

Partner and Head of Dispute Resolution, Mark Whelan commented: “Like a vast number of SMEs in this country at this time, our client needs swift and definitive clarity on its insurance position, as its ability to continue in business once the crisis has receded is dependent on this issue. Whilst in that regard the proposal of the FCA to litigate certain policy wordings was welcome, there was no certainty as to which wordings might be embraced by that, nor what the FCA’s likely timetable might be. In the face of what is believed to be a generic denial of cover from its insurers in response to what is unquestionably a severe interruption to its business, our client has no choice but to pursue this litigation to a hopefully swift resolution”.
