Memery Crystal obtains summary judgment in copyright infringement claim on behalf of AlchemyBet Limited

Memery Crystal is delighted to announce that its Commercial, IP and Technology team has successfully obtained summary judgment for their longstanding client AlchemyBet in the action AlchemyBet Limited v Trinitas Gaming Ltd (trading as “Rogue”) Philip Halston and Dan Lamond. The action involves allegations of copyright infringement, breach of contract and breach of confidence. AlchemyBet is the owner of the intellectual property rights in the well-known Slingo range of gambling games.

Copyright claim

The Defendants initially denied any copying. However, the Memery Crystal team put forward a detailed analysis of the code base for infringement and, based on Rogue’s front end codes for several of its games, the Defendants conceded that they would not be offering any evidence against the front-end claim.

Memery Crystal’s litigation team therefore sought and obtained summary judgment in relation to that part of the infringement of copyright and breach of contract claim. The Court has ordered an injunction, publication of the judgment on the First Defendant’s website and an inquiry into damages. The rest of the case continues.
