    Expertise

    Kelly Seal has been with Memery Crystal throughout her legal career, completing her training with the firm nearly ten years ago, and is now a Partner.

    Kelly’s experience covers both commercial and residential property, with specific expertise in landlord and tenant issues and disputes. Her practice includes advising on the property portfolio of the firm’s long standing client, The Freshwater Group of Companies, dealing with their individual flats to large mansion blocks (including the second largest in London).  Her day-to-day work typically involves advising on breaches of covenants such as service charges, alterations, disrepair and nuisance. Kelly regularly provides in-house seminars to clients on dealing with property management issues such as water ingress and unauthorised subletting.

    Kelly’s approach recognises that it is rarely in her client’s interests to litigate in order to resolve disputes, instead successfully achieving results through effective mediation. She is committed, motivated and works tirelessly for her clients from the outset, to engage all parties in working towards an early resolution. She gets the best outcome for her clients by identifying the key issues, thinking creatively to meet their commercial interests, and implementing and delivering these objectives using her leading and communication skills.

    Outside of work, Kelly is a full time mother of two young daughters, with their ever growing number of family pets; meeting the challenge of balancing her children’s busy social lives, with the occasional “date night” with her husband and meeting up with friends for dinner and the theatre.

    Recent experience

    • Advising a commercial landlord as to the status of a residential occupier and rights of succession to a rent act tenancy and successfully recovering possession.
    • Advising landlords on enforcement action and remedies available in cases of unlawful subletting being let for example via Airbnb.
    • Advising landlords on the statutory consultation procedure in a number of cases for major works projects.
    • Advising a commercial landlord as to the status of an assured tenant following succession to a rent act tenancy in circumstances where the premises were being unlawfully sublet and no longer occupied by the tenant and successfully recovering possession.
